Terms & Conditions of Sale / Supply / Installation


1 Basis of sale

a. These Standard Conditions of sale govern all contracts for the sale of the Company’s goods or the Supply of its Services.
b. Variation of these conditions shall only be binding when agreed in writing by the Company.
c. The Company’s Employees or Agents are not authorised to make any representations concerning the goods or services unless confirmed by the Company in writing.

2. Product Description 
All metal garage doors supplied by the Company come in primer or powder coat primer unless otherwise stated.

3. Orders
a. The Customer shall be responsible for the accuracy of the information and the sizes given to the Company for its Goods and supply of Services.
b. Whilst every effort is made to advise the Customer as to the size, mechanism, type etc of the door needed to fit their garage, no responsibility is taken by the Company if measurements and information given by the Customer are inaccurate, non-specific or incomplete. This includes but is not limited to:
i. The presence of low beams
ii. Gas/electric meters on the sidewalls
iii. Uneven floors or walls being out of plumb
iv. Similar obstructions which would impair the normal fitting and path of travel of the garage door purchased
v. Colour, colour match and design of the door
c. Quotations are not offers and may be withdrawn or revised at any time before acceptance of an order by the Company.
d. Any order that has been accepted by the Company may only be cancelled or amended by the Customer with the written agreement of the Company and on terms whereby the Customer shall indemnify the Company in full against any loss incurred as a result of any such cancellation.

4. Sale of Spare Parts 
a. All spare parts ordered ex stock from the Company may only be returned if unopened. All spare parts specially ordered by the Company for a Customer with the manufacturer may only be returned if unopened. 

5. Price and Payment 
a. All prices quoted are based on current price lists for the goods and are only valid for 30 days.
b. The Company reserves the right to increase the price of goods or services to reflect any increase in cost to the Company.
c. Prices Include Delivery unless otherwise specified.
d. All goods are ordered on a supply only basis unless otherwise stated.
e. All garage doors that are specially made to order must be paid for in full at the time of placing the order unless otherwise agreed by the Company.

6. Delivery
a. The Customer must make themselves or their Agent available to take delivery. The Agent must be over 18 years of age.
b. The Customer must thoroughly check the condition of the goods at the time of delivery.
c. Goods cannot be signed for as “unchecked” or “unexamined”. If any damage is noted, this must be written as clearly and as accurately as possible onto the delivery note.
d. Notice of any damage must also be given to the company on the same day by telephone and in writing within 24 hours. Damaged goods must remain unused and unfitted, and stored carefully complete with any packaging until the Company or its agent is able to examine the goods.
e. If the Customer fails to take delivery of the goods or fails to give the Company adequate delivery instructions then the Company may arrange to store the goods and charge the Customer for the reasonable costs of such storage and re-delivery cost.

f. Delivery may take up to a maximum of 28 days from date of order depending on the product.

7. Installation
a. All garage doors, remote controls and spare parts are sold on a supply only basis, unless otherwise agreed in writing.
b. All garage doors, remote controls and spare parts must be fitted in accordance with the manufacturer’s fitting instructions and no responsibility is taken by the Company for these installations.
c. If the installation is agreed in writing to be performed by the Company:
i. The installation costs specified cover only the work specified and do not, unless expressly stated, include rectification of existing out of square openings or removal or disconnection of old doors and fittings or electricity or gas fittings or the like, and
ii. The Company shall not be responsible for the removal or taking away and disposing of any old doors unless stated in the estimate, and
iii. Whilst all reasonable care will be taken while drilling and fixing, the Company and its installers shall not be responsible for the failure from any cause whatsoever of any existing timber, masonry or rendered surfaces while drilling or fixing.

iv. When installing a door not supplied by ourselves, especially if second hand, the quoted amount does not include any additional equipment, special fixings or spare parts and if they are required a second additional payment is required to cover these costs.

8. Replacement Under Warranty
All replacement goods under warranty that have been sold on a supply only basis which have already been fitted by the Customer will be replaced on a supply only basis. If the manufacturer of the door chooses to install the replacement it is only by their goodwill.

9. Ownership and Risk
The goods shall remain the property of the Company as legal and equitable owner and no property in them shall pass to the Customer until their full price has been duly paid to and received by the Company together with all other sums whatsoever which are or may become due from the customer.

10. Third Party Liability
The Company shall not be responsible for damage, injury or loss of any kind whatsoever to any property or persons arising from the use of the goods or in connection with the installation of the same.
11. Delay and Force Majeure
a. Any delivery or installation dates given are approximate only and the Company accepts no liability for delay arising from any cause whatsoever.
b. The Company shall not be liable to the Customer or be deemed to be in breach of the contract by reason of any delay in performing, or failure to perform, any obligation of the Company under the contract if such delay or failure was due to any cause beyond the Company’s reasonable control including (but not limited to) Act of God, explosion, flood, tempest, fire, accident, war, threat or hostilities, sabotage, civil disturbance, acts and regulations of any authority, import or export regulations, industrial disputes, difficulties in obtaining materials or labour, power failure or machinery breakdown.

12. Refunds, Returns and Cancellations.

If you change your mind
If you have changed your mind about any item you've ordered and wish to return it, then in line with the EU Distance Selling Regulations (D.S.R.) you can do so provided you inform us of your decision within seven (7) days of receipt.  The item must not be used and must be 'as new' complete with original packaging & accessories when returned to us. Once you've informed us that you wish to return goods under the D.S.R., you have 28 calendar days to do so at your own expense and for your protection, we strongly recommend that you insure your return shipment against loss or damage, and that you use a shipper that can provide you with proof of delivery. Once the item is received we'll issue a full refund for the product to your original payment method (not including shipping and third party payment processing costs incurred)  Please note this returns policy has some limitations and does not apply to business customers. REFUNDS WILL BE MINUS THE SHIPPING COSTS INCURRED.

Return of goods outside the 7 day period as described above
We may at our discretion accept goods back for refund up to 28 days after they were supplied, in which case, 50% of the purchase price will be deducted in addition to the shipping charge.  We request that you contact us prior to returning any goods and we strongly recommend that you insure your return shipment against loss or damage and that you use a shipper that can provide you with proof of delivery.
Special Order Items - NOT covered under the Distance Selling Regulations as stated below:

Exceptions to the right to cancel an order or supply contract
     
13.  - (1) Unless the parties have agreed otherwise, the consumer will not have the right to cancel the contract by giving notice of cancellation pursuant to regulation 10 in respect of contracts - 


This covers any items which are ordered on your behalf from a 3rd party (such as a distributor or manufacturer of our products). NO REFUND MAY BE GIVEN ON THESE ITEMS unless stated otherwise.  In this case you will be given a "Cooling Off" period of 7 calendar days.  During this period you may cancel the order at any time for any reason with no financial penalty, however after said period we are unable to cancel any order and full payment for said order must be made.  You will be informed as to whether your order will fall into this category before any payment is taken, after which time you are bound by this clause.  Goods under this clause include: All Garage Doors and Awnings fall into this category as they are all "Made to Measure" and certain spares. Special order items such as garage door springs that have been despatched direct from our supplier may be returned for refund but 50% of the original price will be deducted to cover courier delivery costs and third party payment processing costs incurred. Once you've informed us that you wish to return the goods you have 28 calendar days to do so at your own expense and for your protection, we strongly recommend that you insure your return shipment against loss or damage, and that you use a shipper that provides parcel tracking information.
Items Damaged in Transit
If any items were damaged in transit, we ask that you report it to us within 7 days.  If the items are visibly damaged on receipt, it's best to sign the carrier's delivery note accordingly. Items should be returned in their original packaging complete with all accessories and documentation. Once received back at our premises, we'll issue a replacement or full refund to you via your original payment method.
If your items are faulty on arrival, you have 28 calendar days in which to inform us of the fault. Items should be returned in their original packaging complete with all accessories and documentation. Once we have verified the fault, we'll issue a replacement or full refund to you via your original payment method. We test all returned items, and if a returned item is found not to be faulty we will return the item to you, in this instance you may be liable for the return carriage.
If goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us we will meet the cost of return but we ask that you allow us to nominate the carrier.
Faulty Goods Outside The First 28 days
If a product is deemed defective outside the first 28 days but within the manufacturers warrantee period you are requested to notify us prior to returning the goods for inspection. The goods should be returned to us at your own expense and for your protection, we strongly recommend that you insure your return shipment against loss or damage, and that you use a shipper that provides parcel tracking information.  Please note that you will be requested to pay the cost of return postage or carriage.
Liability
If you have notified us of a problem with the goods, we will (at your option) either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. All goods supplied by us, the seller are warranted fit for the normal purpose for which such goods are intended.  No liability is accepted if the goods are found not to be fit for any other purpose whether or not such other purpose was made known to the seller before the contract was made.  Any recommendations made by the seller in such circumstances are made in good faith but as the conditions of use are outside the control of the seller it is for the purchaser to satisfy himself as to the suitability of the goods. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. In no circumstances is the seller liable for any loss, personal injury or damage arising from self installation of goods supplied.


Goods Damaged in Transit
Check the packaging for damage before signing for a delivery from our courier.  In the unlikely event of damage please either sign for the goods as “Received Damaged” or reject the goods as damaged and call us immediately as our couriers will not accept responsibility of any transit damage unless notified within three days.

 

Law
The contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English Courts.

 

14. Security
Buying online with I.Myers and www.myersgaragedoors.co.uk is 100% safe. We use Google Checkout for simple and secure processing of internet payments.  We reserve the right to apply a small extra charge if goods are paid for with a credit card to cover the costs of processing such transactions, any such charges will be clearly stated before the transaction takes place.
